1. The action must cause harm to other people, or to socoety.

2. The harm must be serious, both in nature and degree.

3. The harm must be best dealt with through the mechanism of criminal law.

Advantages- It gets rid of the criminals

- people know about the dangerous criminals that get put away

Disadvantages- Not all of the criminals are put away

Civil law

Advantages- People get money back for the things that gets wrecked

Disadvantages- The person doing the crime might not learn his lesson and will do it again and again.
